This Privacy Policy and Disclosure Statement explains in general terms how Novogen protects the privacy of your personal information under the National Privacy Principles in compliance with Australian privacy laws. It also sets out the matters which we are required to disclose to individuals under National Privacy Principles 1.3 and 1.5. The principles set out in this Privacy Policy and Disclosure Statement will apply to any personal information you provide to Novogen via our web site, through our health information telephone services or under any other agreement or arrangement and to information which we collect about you from other sources.
This Privacy Policy and Disclosure Statement does not apply to acts and practices of Novogen which relates directly to the employee records of our current and former employees.
How we collect your personal information
We generally collect your personal information directly from you. For example, we may collect personal information about you when you deal with us over the telephone, send us your details through correspondence (whether by letter, fax or e-mail), visit our web site, purchase our products from our web site or when you have contact with us in person.

In certain circumstances, we may also collect sensitive information about you such as information about your health (including any disability), your medical history and details about your current medications.
There may be occasions when we need to source your health information about you from a third party. For example, we may collect health information about you from a health care professional who is treating you such as a medical practitioner or physiotherapist, or a pharmacist.
You consent to us collecting your sensitive information for the purpose of us providing our goods and services to you.

Wherever it is lawful and practicable, we will provide you with the option of not identifying yourself when entering transactions with us.
Our disclosure statement
Novogen collects personal information and sensitive information for the following purposes:

• to accurately record information of suspected adverse events to any of our products as required of us by law, such as the Therapeutic Goods Act 1989 (Cth);

• to send you general promotional material which we believe may be useful to you;
• to monitor who is accessing the Novogen web site or using services offered on the web site; and
• to profile the type of people accessing our web site.
If you do not provide us with your personal information we may not be able to provide our products to you, send you information or provide any of our related services. If you do not provide us with your health information, we may not be able to assist you in providing information of the right product for your particular health condition.
In some circumstances, we collect personal information about you from a third party source. If we collect personal information about you in this way, we will take reasonable steps to contact you and ensure that you are aware of the purposes for which we are collecting your personal information and the organisations to which we might disclose your personal information.

• Regulatory bodies (eg Therapeutic Goods Agency in the event of a suspected adverse event to a product which is to be reported) or as generally required by law;
• Customer service or call centre acting on behalf of Novogen;

How we use or disclose your personal information
We will use and disclose personal information for the primary purpose for which it was collected. We may also use and disclose personal information for purposes related or ancillary to the main reason we collect it, such as: for our own statistical analysis and profiling of our customers, visitors to our website and people who use our health line telephone service. We do not disclose personal information we collect to third parties for the purposes of allowing them to direct market their products and services.
We will engage third party contractors to perform services for us for time to time which will involve the contractor handling personal information we hold. For example, we engage third party contractors to:
• Maintain and manage our data bases which will contain personal information and sensitive information;
• provide web hosting services to us;
• provide customer service call centres; and
• provide marketing services.
In these situations, we prohibit the third party contractor from using personal information about you except for the specific purpose for which we supply it, in particular we will not provide your sensitive information to our contractors for marketing purposes unless you expressly consent to us doing so.
Sharing information within the Novogen group
We share personal information with our related bodies corporate in Australia which include sensitive information about you such as information about your health (including any disability), medical history, current medications, age, occupation and interests.
Each Novogen entity in Australia may disclose personal information to other Novogen entities in Australia which will use and disclose the information only for the purpose for which it was originally collected. We may hold your health information on a health records linkage system for the purposes of sharing your health information as described under this paragraph. By providing your health information to use, you consent to us sharing your health information with other entities in the Novogen group.
Gaining access to information we hold about you
Novogen will, on request, provide you with access to the personal information we hold about you, unless there is an exception which applies under the Privacy Act 1988 (Cth).
Your request to obtain access will be dealt with in a reasonable time. Novogen may recover from you its reasonable cost of providing you with access.
If Novogen refuses to provide you with access to the information, Novogen will provide you with reasons for the refusal and inform you of any exceptions relied upon under the Privacy Act 1988 (Cth).
Keeping your personal information up-to-date
We take reasonable steps to ensure that your personal information is accurate, complete, and up-to-date whenever we collect or use it.
If you find that the personal information we hold about you is inaccurate, incomplete or out-of-date, please contact us immediately and we will take reasonable steps to correct this information, or if necessary, we will discuss alternative action with you.
Security of your personal information
We protect any personal information that we hold from misuse and loss. We also protect it from unauthorised access, modification and disclosure.
Your personal information may be stored either in hardcopy documents, as electronic data, or in Novogen's software or systems.
We maintain physical security over our paper and electronic data stores and premises, such as locks and security systems. We also maintain computer and network security; for example, we use firewalls (security measures for the Internet) and other security systems such as user identifiers and passwords to control access to computer system.
Transfer of information to foreign countries
We may transfer certain information to our related companies in the Novogen group in foreign countries for inter company data comparisons and collation including information relating to individual's health, including medical history, current medications, age, occupation and interests, however this information is de-identified prior to it being provided.
